ToS - X43 Fleet

This Terms of Service outlines the expectations and limitations related to the handling, representation, and donation-based acquisition of custom-built model vehicles by X43 Fleet (“X43”). By acquiring, displaying, or interacting with an X43 model, you (“the Client”) agree to the following terms:

I. INTENDED USE

X43 models are precision-crafted for private display, collection, and artistic appreciation. They are not toys and are not intended for individuals under 14 years of age. Each model should be handled with care and kept out of environments that may cause damage.

II. DONATION BASED STRUCTURE

X43 Fleet does not sell products in a commercial capacity. This project operates on a donation-based structure designed to support our community recognition initiatives—particularly the Nominate Your Hero program.

All contributions made through PayPal, Venmo, Cash App, or other third-party platforms are considered voluntary donations, not payments for goods. This website does not process e-commerce transactions.

Donations help cover time, materials, and creative labor. Any model received is a gift of appreciation, not a purchased product. By donating, you acknowledge that:

• No goods or services are owed or guaranteed in return

• Selection and distribution is at the discretion of X43 Fleet

• Participation does not entitle you to ownership or compensation

III. WARRANTY POLICE - 1-YEAR LIMITED

While not a commercial entity, X43 offers a 1-year limited warranty for issues affecting basic model integrity under normal indoor display.

Covered:

• Peeling, fading, or cracking decals caused by production or shipping defects

Not Covered:

• Damage from heat, water, or UV exposure

• Mishandling, modification, or play

• Normal wear and tear

Warranty claims require clear photo documentation and original donor information. All claims are subject to X43’s discretion.

IV. DESIGN ATTRIBUTION & AGENCY CONSENT

X43 models are often inspired by real-world fleets, typically submitted by verified personnel who are current or former members of the respective agencies.

If any agency representative with clear overriding authority objects to the use of their design, markings, or likeness, X43 will promptly comply with any formal cease and desist request and discontinue the associated builds.

We respect the work — and those who represent it.

V. USE RESTRICTIONS

Models may not be used to:

• Impersonate law enforcement or emergency services

• Violate local, state, or federal law

• Cause public confusion or misrepresentation

Clients accept full responsibility upon receiving a model. X43 disclaims liability for any misuse, unauthorized use in public, or actions taken by third parties involving the model.

VI. NON-AFFILIATION NOTICE

X43 is a private, independent creative studio. It is not affiliated with any government agency, law enforcement department, fire service, EMS, or military organization. Any resemblance is purely artistic and does not imply official endorsement.

VII. RIGHT TO REFUSE

We reserve the right to refuse a request or donation if it misrepresents the brand, disrespects the agencies that inspire us, or conflicts with the values behind the Nominate Your Hero initiative.
